AxCrypt AB provides downloadable software and online services collectively called “AxCrypt” for protecting confidentiality through the use of strong encryption. We do so under our no-nonsense terms, avoiding lengthy legal wording as much as possible. Legal representatives must try to interpret the intent and spirit of these terms, as if they were expressed using traditional formal legal language.

AxCrypt performs local encryption and decryption of files, and server-based encryption and decryption of encryption keys and optionally passwords stored there. AxCrypt provides different type of subscription plans: AxCrypt Viewer, AxCrypt Free and AxCrypt Premium. Plans are offered at our discretion on select platforms.
AxCrypt Viewer is available for anyone without cost. AxCrypt Viewer enables you to access and decrypt files, and to access, but not modify, information stored in the password manager.
Technical support may be provided depending on availability.
AxCrypt Free is available for anyone without cost with the open source version of AxCrypt that is licensed under GPL, version 3. AxCrypt Free enables you to access, encrypt, decrypt files; and to access, but not modify, the information stored in the password manager.

AxCrypt Premium requires payment as specified at https://www.axcrypt.net/pricing/. AxCrypt Premium provides extended functionality.
If your Premium subscription runs out, you will fall back to Free or Viewer as appropriate. A significant effort is made to keep AxCrypt services available at all times. We are not responsible for unavailability due to issues outside of our control, such as major network failures. We also keep the server data backed up in a separate location.
Technical support will be provided by AxCrypt. We do not guarantee to solve all problems. AxCrypt will give higher priority to Premium support.
AxCrypt Free is free software; you can redistribute it and/or modify it under the terms of the GNU General Public License version 3 or later version as published by the Free Software Foundation. You should have received a copy of the GNU General Public License along with this program; if not, see https://www.gnu.org/licenses/lgpl.txt . If you modify the software and redistribute it, you must communicate the code source of the modified version. The use of the modified version must be done under the same GNU General Public License.
You agree to use AxCrypt only for purposes that are legal, and never in any way that could cause us legal liability or cause problems for others.
When you register as a private user, we do not require any personal information from you, except a working email address. You have to provide correct and up-to-date data when registering for AxCrypt. You have to ensure that emails can be received.
We may from time to time ask you for other information through user surveys and similar, but it is always optional to participate. Through the use of AxCrypt, we will perform normal logging of requests to our servers. Updates to AxCrypt
We may, without prior notice, modify or update AxCrypt and by continuing to use AxCrypt you automatically continue agree to these terms.
We may offer you to try Premium for free, giving you access to AxCrypt Premium for a limited number days. Such offers are made per person, not per AxCrypt ID. AxCrypt reserves the right, to withdraw or to modify such offers at any time without prior notice and without liability.
Payment and renewal
AxCrypt will provide Premium services after receiving payment. Your personal payment details are never sent to or stored on our servers. We send them directly from you to our payment gateway partners via an encrypted connection. We partner with Stripe and PayPal, both of which meet the high standards set by the Payment Card Industry Data Security Standard.
We may change the price of our subscriptions at any time, but it will not affect your current subscription period. Thus, the new prices will apply on your next subscription. If you disagree with the changes, simply do not renew your subscription.
We will always offer a no questions asked refund if requested within a reasonable amount of time, but always for at least 30 days. Please inform us via email as soon as possible should you wish a refund. Refunds are issued by reversing the initial transaction, unless we agree on other means.
Disclaimer of warranties
The software is provided without absolutely any warranty.
Disclosure to third parties
We will not disclose any information about you as a result of using AxCrypt to third parties without your explicit consent, unless required by law.
Disclosure to authorities and law enforcement
In theory, we may be forced by law to disclose information to government authorities. If required by law, we will comply. Such information is by definition limited to what we actually have, i.e. statistics, access logs and encrypted data files. We do not know your password, nor do we know what information you have stored, and cannot disclose this even if required by law because we do not know it.
It is our belief, although it is probably not tested in the legal system, that we cannot be forced to reprogram AxCrypt in a way that would make it possible to intercept your passwords in order to disclose your information. Should such a situation arise we will do our best within our legal rights to inform our users, possibly by shutting down the service as a last resort.
“AxCrypt” is recorded in the Register of European Union trade marks. We exclusively own all right, title and interest in and to the software and service, including all associated intellectual property rights.
We are only liable for direct damages, never indirect damages. If we lose or disclose information, we are only liable for direct costs to recover it, reconstruct it or invalidate it, never for any other costs.
We are only liable for information disclosure or data loss that you can show is due to unprofessional implementation or management by us. We are not liable for any inherent weaknesses that may be discovered in the security technology used.
Your information is kept confidential by the use of standardized strong encryption methods, documented at https://www.axcrypt.net/documentation/technical/ and in the source code at https://bitbucket.org/axantum/axcrypt-net. If you choose a weak password, your data may be at risk of disclosure. We do not guarantee or verify that you choose a sufficiently strong password.
We only provide AxCrypt and are never responsible for any illegal or fraudulent actions taken by others using it. As a user, you are entirely responsible for your actions using AxCrypt. We are never liable for damage that could have been prevented by timely backup, or caused by forgotten passwords.
Our liability can never exceed the amount paid for the service.
Our website may contain links to other websites. Those websites are only provided to be used as a reference. AxCrypt AB does not control the content of those websites and does not take any responsibility it.
Dispute and validity
Should you wish to take legal action against us, you must do so under the laws of Sweden, and in a court of law in Stockholm, Sweden.
The English version of this agreement governs in case of dispute. Any translations are provided for convenience only and cannot be used to interpret the English version.
If any part of this agreement is found to be invalid, it does not invalidate any other part of the agreement, and the new interpretation should be as close to the original as allowed.
